Delight Station Terms of Use

These Terms of Use are an agreement between you and Delight Station LLC, referred to as “Delight Station,” “we,” “us,” or “our.”

These Terms apply to delightstation.us and the related pages, memberships, videos, and services offered by Delight Station, collectively referred to as the “Service.”

By creating an account, purchasing a membership, clicking to accept these Terms, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Authority

You must be at least 18 years old and legally able to enter into an agreement to create or manage a Delight Station account.

If you use the Service for another person, a household, a school, a provider, a program, or another organization, you represent that you are authorized to manage the account and agree to these Terms on behalf of yourself and, when legally permitted, that organization.

You may not accept a release of another person’s legal rights unless you have the legal authority to do so.

2. About Delight Station

Delight Station is an online video library of activities and entertainment created specifically for people with intellectual and developmental disabilities.

Content may include art, cooking, movement, music, wellness, life skills, recreation, and community experiences.

Delight Station provides prerecorded content. It does not provide medical care, therapy, personal care, emergency services, professional supervision, or individualized medical or clinical advice.

3. Accounts

You agree to provide accurate information and keep it reasonably current.

You are responsible for protecting your password and account credentials. You are also responsible for activity performed through your account unless you have notified us that the account has been accessed without permission.

Contact us promptly at ben@delightstation.us if you believe your account has been compromised.

4. Memberships, Billing, and Cancellation

Membership prices, billing intervals, and any trial or promotional terms are shown when you purchase a membership.

If you purchase a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with your account at each renewal until you cancel.

You may cancel a recurring membership using the cancellation method available through your account or by contacting us. To avoid the next recurring charge, cancellation must be completed before the renewal is processed.

Cancellation normally takes effect at the end of the current paid billing period. Unless required by law or expressly stated otherwise at the time of purchase, payments already made are nonrefundable and are not prorated.

We may change membership prices. If a change affects an existing recurring membership, we will provide notice before the new price is charged.

Payments are processed by Squarespace and its payment providers. Their separate terms and privacy policies may also apply to payment processing.

5. Permission to Use Delight Station

While your membership is active, Delight Station grants you a limited, nonexclusive, nontransferable, and revocable license to stream the content for its intended purpose.

An account holder may use the Service personally and may display content to members of the account holder’s household.

A caregiver, educator, provider, or program may also display content to participants the account holder or organization is directly serving at a single program or service location, unless Delight Station has stated otherwise or entered into a separate written agreement.

This permission does not allow you to:

  1. Share account credentials outside your household or organization.

  2. Use one membership simultaneously across multiple program locations.

  3. Resell access to the Service.

  4. Charge admission to view Delight Station content.

  5. Download content unless a download feature is expressly provided.

  6. Copy, record, reproduce, republish, upload, distribute, or rebroadcast videos.

  7. Stream the content publicly over the internet or another broadcast system.

  8. Remove copyright, branding, or ownership notices.

  9. Attempt to bypass access controls or interfere with the Service.

  10. Use the Service for unlawful, abusive, fraudulent, or harmful purposes.

Contact us if you need permission for use across multiple locations or under a different organizational arrangement.

6. Intellectual Property

The Service and its content, including videos, scripts, text, graphics, designs, logos, trademarks, music, and other materials, are owned by Delight Station or used with permission.

Except for the limited permission provided in these Terms, no ownership or intellectual property rights are transferred to you.

The names “Delight Station” and associated logos and branding may not be used in a way that suggests sponsorship, endorsement, or affiliation without permission.

7. Availability and Changes

We may add, remove, replace, or modify content and features.

We do not guarantee that a particular video or feature will remain available indefinitely or that the Service will always operate without interruption or error.

We may temporarily suspend access for maintenance, security, technical problems, legal requirements, or circumstances outside our reasonable control.

8. Choosing Appropriate Activities

Some Delight Station videos involve physical movement, exercise, stretching, cooking, food, craft supplies, tools, household objects, or activities performed in the community.

Not every activity is appropriate for every participant.

Before participating, the participant or responsible adult should consider the participant’s abilities, mobility, health, allergies, medications, judgment, environment, and need for assistance or supervision.

The responsible adult should:

  1. Review the activity when appropriate.

  2. Provide the level of supervision and assistance the participant needs.

  3. Use appropriate equipment and safety precautions.

  4. Make reasonable modifications based on the participant’s abilities.

  5. Ensure that the activity area is reasonably safe.

  6. Consult an appropriate healthcare professional when there is uncertainty about whether an activity is suitable.

  7. Stop participation if the participant experiences pain, dizziness, unusual shortness of breath, distress, illness, or another concerning symptom.

Delight Station cannot observe participants, evaluate their individual needs, or respond to an emergency.

9. Assumption of Risk

Participation in physical and practical activities involves risks that cannot be completely eliminated.

Depending on the activity and participant, these risks may include falls, strains, sprains, collisions, choking, allergic reactions, burns, cuts, illness, emotional distress, property damage, serious injury, or death.

Participation is voluntary.

By choosing to participate, each adult participant knowingly accepts the inherent and reasonably foreseeable risks of the activity. A parent, guardian, caregiver, or responsible adult who selects or supervises an activity accepts responsibility for making an appropriate and informed choice and for providing necessary assistance and supervision.

10. Release of Ordinary Negligence Claims

To the fullest extent permitted by applicable law, each adult subscriber and adult participant releases Delight Station LLC and its owners, officers, employees, contractors, instructors, agents, representatives, successors, and assigns from claims for personal injury, death, or property damage arising from ordinary negligence in connection with participation in an activity presented through the Service.

This release does not apply to gross negligence, reckless conduct, willful or wanton conduct, intentional misconduct, fraud, or any liability that cannot lawfully be waived.

A parent or legal guardian may accept this release for a minor only to the extent permitted by applicable law.

A person acting for an adult who has a legal guardian or other authorized representative may accept this release on that person’s behalf only if the person accepting it has the legal authority to do so.

A caregiver, employee, teacher, or program representative who does not have that authority accepts these Terms only for their own conduct and responsibilities. They remain responsible for obtaining any permission or authorization required from the participant or the participant’s authorized representative.

11. Responsibilities of Organizations and Providers

Organizations using Delight Station remain responsible for:

  1. Selecting content appropriate for their participants.

  2. Providing appropriate staffing, assistance, and supervision.

  3. Following applicable licensing, safety, employment, educational, and care requirements.

  4. Obtaining required participant, parent, or guardian permissions.

  5. Protecting account credentials.

  6. Complying with privacy and confidentiality requirements that apply to their work.

  7. Responding to participant needs and emergencies.

Delight Station does not assume the duties of the organization, provider, caregiver, teacher, or other responsible adult.

12. No Professional Advice or Guaranteed Outcome

The content is provided for general educational, recreational, and informational purposes.

It is not a diagnosis, treatment plan, medical recommendation, therapy plan, behavioral plan, dietary prescription, or individualized professional recommendation.

Participation does not guarantee any particular educational, developmental, physical, emotional, or other outcome.

13. Third-Party Services

The Service may rely on or link to third-party services, including Squarespace and Vimeo.

Those services may have their own terms and privacy policies. Delight Station is not responsible for the independent acts, omissions, availability, security, or content of a third-party service.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and its content are provided “as is” and “as available.”

Delight Station disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not guarantee that the Service will be uninterrupted, error-free, completely secure, or suitable for every participant or situation.

Nothing in these Terms excludes a warranty or consumer protection that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by law, Delight Station will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, loss of goodwill, or loss of business opportunity.

To the fullest extent permitted by law, Delight Station’s total liability arising from the Service will not exceed the amount you paid to Delight Station during the 12 months before the event giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

16. Indemnification

If you use the Service for an organization or in a professional capacity, you agree to defend, indemnify, and hold harmless Delight Station and its owners, officers, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable costs arising from:

  1. Your violation of these Terms.

  2. Unauthorized sharing, copying, distribution, or commercial use of the Service.

  3. Your failure to obtain permissions or authority required for participants under your supervision.

  4. Your failure to provide supervision or assistance for which you or your organization is responsible.

  5. Your unlawful or improper use of the Service.

This section does not require you to indemnify Delight Station for claims caused by Delight Station’s gross negligence, reckless conduct, willful misconduct, or other conduct that cannot legally be protected.

17. Suspension and Termination

You may stop using the Service and cancel your membership at any time.

We may suspend or terminate access if we reasonably believe you have violated these Terms, misused the Service, failed to pay an amount due, created a security risk, or exposed Delight Station or another person to legal liability.

When access ends, the license granted under these Terms also ends. Sections that logically should continue after termination, including intellectual property, payment obligations, assumption of risk, releases, liability limitations, and dispute provisions, will remain in effect.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Service must be brought in a state or federal court with jurisdiction in Larimer County, Colorado.

19. Severability and No Waiver

If a court determines that part of these Terms is invalid or unenforceable, that provision will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.

If Delight Station does not immediately enforce a provision, that does not waive the right to enforce it later.

20. Changes to These Terms

We may update these Terms as our services or legal obligations change.

We will post the updated Terms and revise the effective date above. If a change materially affects an active paid membership, we will provide additional notice when reasonably appropriate.

Continued use after updated Terms take effect constitutes acceptance of the updated Terms. When required, we may ask you to affirmatively accept a new version.

21. Entire Agreement

These Terms, the Privacy Policy, and any additional written terms presented during a purchase or agreed to directly with Delight Station constitute the agreement between you and Delight Station concerning the Service.
